It’s been a rough few months for the Ebay folks. They have fallen victim to huge lawsuits. Hermes and Louis Vuttion both cried foul (and rightfully so) against Ebay for allowing sketchy sellers on their site to push fake replicas of the luxury label’s handbags.
But, as the old adage goes, every gray cloud has silver lining, and it seems Ebay has finally found its.
Yesterday, a federal judge in Manhattan ruled in favor of Ebay for a trademark infringement lawsuit brought against them by Tiffany & Co.
According to the judge, the luxe jeweler, “failed in its burden to prove claims that eBay was liable for trademark infringement and dilution, false advertising and unfair competition for facilitating the sale of counterfeit goods.”
Considering Hermes and Louis Vuttion just won cases by filing similar charges against Ebay, it strikes me as odd that Ebay came out as the victor on this one. It must be because the prevalence in which Tiffany gets knocked-off isn’t on the same scale as the aforementioned labels. But counterfeit sales are still really bad.
Hm. Maybe the fact that anybody rocking L. Woods heart toggle necklaces post the Legally Blonde era really isn’t a crime?
